Any immovable property delivery, i.e., entry into possession of an immovable property, is the procedure that goes through several stages:
1) going to visit, before signing and verifying Sales Contract, immovable property concerned, where the inspection whether such immovable property has been freed from persons and things shall be carried out;
2) going to the relevant court to verify related Sale Contract;
3) payment of sale price, in the designated bank;
4) going to such purchased immovable property, and official delivery of its keys.
The verification of sale contracts may be performed in two ways:
1) Buyer and seller go, together with the Agency’s Lawyer, to the court having jurisdiction ratione loci,
2) Our lawyers offer the possibility to invite law official in charge to make on-the-spot verification of Sale Contract, which procedure has the same sufficiency at law and implies payment of costs for the law official services in addition to usual court office fees.
Once a property is found, Montenegro has a well established computerized Land Registry that holds details such as property size and land boundaries.
The whole process can take up to some days.
